  4. InfoRecall is copyrighted by Curtram Investments. You should
  5. carefully read all the terms and conditions of this agreement
  6. prior to using this software.If you do not agree to the terms
  7. of this agreement, do not open the disk package. Promptly
  8. return the unopened disk package and other items that are part
  9. of this product to the place you obtained them for a full refund.

  12. You may not sub license, assign or transfer the license or the
  13. program except as expressly provided in this Agreement. Any
  14. attempt otherwise to sub license, assign or transfer any of
  15. the rights, duties or obligations here under is void.

  17. LICENSE
  18. You have the non-exclusive right to use this software for a 
  19. 30 day trial period. You may freely distribute copies of the 
  20. software to others. This software can only be used on a single 
  21. computer. You may not modify or translate the software or user 
  22. manual without the prior written consent of Curtram Investments Ltd. 
  23. You may not use, copy, modify, or transfer the software or any 
  24. copy, modification or merged portion in whole or in part, 
  25. except as expressly provided for in this license.

  27. LIMITED WARRANTY
  28. This software is provided "as is" without warranty of any kind,
  29. either expressed or implied, including, but not limited to,
  30. the implied warranties or merchantability and fitness for a 
  31. particular purpose.  The entire risk as to the quality and
  32. performance of the software is with you. Should the software
  33. prove defective, you (and not Curtram Investments Ltd. or an
  34. authorized personal computer dealer) assume the entire cost of
  35. all necessary servicing, repair or correction. Some states do
  36. not allow the exclusion of implied warranties, so the above
  37. exclusion may not apply to you. This warranty gives you
  38. specific legal rights and you may also have other rights which
  39. vary from state to state.

  41. Curtram Investments Ltd. does not warrant that the functions
  42. contained in the software will meet your requirements or that
  43. the operation of the software will be uninterrupted or error
  44. free.  However, Curtram investments Ltd. warrants the 
  45. supplied diskettes to be free from defects in materials and
  46. workmanship under normal use for a period of ninety(90)
  47. days from the date of delivery to you as evidenced by a copy
  48. of your receipt.

  50. LIMITATIONS OF REMEDIES:
  51. Curtram Investments Ltd. entire liability and your exclusive
  52. remedy shall be: A. the replacement of any diskettes not
  53. meeting Curtram Investments Ltd. "Limited Warranty" and which
  54. are returned to Curtram Investments Ltd. or an authorized
  55. Computer Dealer with a copy of your receipt, or, B. if Curtram
  56. Investments Ltd. or the dealer is unable to deliver a
  57. replacement diskette(s) which is free of defects in materials
  58. or workmanship, you may terminate this Agreement by returning
  59. the program.
  60.  
  61. IN NO EVENT WILL CURTRAM INVESTMENTS LTD. BE LIABLE TO YOU FOR
  62. ANY DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS OR OTHER
  63. INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR
  64. INABILITY TO USE SUCH SOFTWARE EVEN IF CURTRAM INVESTMENTS LTD.
  65. OR ANY AUTHORIZED DEALER HAS BEEN ADVISED OF THE POSSIBILITY OF
  66. SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.

  68. Some states do not allow the limitation or exclusion of liability
  69. for incidental or consequential damages so the above limitation
  70. or exclusion may not apply to you.

  72. This Agreement will be governed by the laws of the Province of
  73. Ontario.  Should you have any questions concerning the Agreement,

  77. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND
  78. IT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU
  79. FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENTS
  80. OF THE AGREEMENT BETWEEN US WHICH SUPERSEDES ANY PROPOSAL OR
  81. PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS
  82. BETWEEN US RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
